Welcome to PerchView, a service of Lake Gulf Holdings LLC (“PerchView,” “we,” “us”). These Terms of Service (“Terms”) govern your access to and use of the PerchView website and applications (the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

PerchView helps people discover events, venues, and things to do in St. Petersburg, Florida and the surrounding Gulf-beach communities. Event and venue information is aggregated from public sources and third parties and is provided on an “as is” and “as available” basis. Details such as dates, times, lineups, pricing, and availability change frequently and may be inaccurate, incomplete, or out of date. Always confirm directly with the venue or event organizer before making plans.

2. Acceptable Use

You agree not to:

Scrape, crawl, harvest, spider, or use any automated means, bot, or data-mining tool to access, copy, or collect content or data from the Service;
Use the Service or its content to train, fine-tune, or develop any machine-learning or AI model or dataset;
Copy, reproduce, republish, resell, or redistribute the Service’s content — including Rio’s recommendations, write-ups, rankings, and our compilation and organization of listings — without our prior written permission;
Access the Service through any automated interface not provided by us, or attempt to circumvent any rate limit, access control, or security measure;
Interfere with, overload, or disrupt the Service or its infrastructure, or attempt to gain unauthorized access to any system or account.

3. Intellectual Property

The Service, including its design, software, the Rio character and voice, and all recommendations, descriptions, rankings, and the selection, arrangement, and compilation of information, is owned by PerchView and protected by intellectual-property laws. Underlying factual event and venue information may originate from venues and other third parties and remains theirs. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes in accordance with these Terms.

4. No Professional Advice

Content on the Service is for general informational purposes only and is not professional, legal, financial, or safety advice. Your use of any venue, event, or third-party service is at your own discretion and risk.

5. Third-Party Content & Links

The Service surfaces information about, and links to, third-party venues, events, and websites. We do not control and are not responsible for third-party content, products, services, or practices. Links and listings do not imply endorsement.

6. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any information is accurate or current.

7. Limitation of Liability

To the fullest extent permitted by law, PerchView and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Service or reliance on any content.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
